Recent News – ADA class action against Right Aid®

Recently, together with our colleagues from Connolly Wells & Gray, LLP, attorneys from Kalikhman & Rayz, LLC initiated a class action against Rite Aid Pharmacy – a national drugstore chain in the United States and a Fortune 500 company that utilizes so-called “point of sale” devices with “touch screen” interfaces to complete debit card transactions, without the assistance of a store clerk or any other third party. As detailed in the complaint, which was filed in the U.S. District Court for the Middle District of Pennsylvania, Right Aid® has engaged in willful violations of the applicable provisions of the Americans with Disabilities Act, 42 U.S.C. § 12101 et seq., and its implementing regulations, because these devices cannot be utilized by blind or visually-impaired persons.
