Recent News – Class Action/Americans with Disabilities Act

Earlier today, together with our colleagues at Connolly Wells & Gray, LLP, attorneys from Kalikhman & Rayz, LLC initiated a class action against Polonia Bank – a Pennsylvania-based financing institution – for failure to maintain automated teller machines (“ATMs”) accessible to individuals with disabilities. As detailed in the complaint, which was filed in the U.S. District Court for the Eastern District of Pennsylvania, Polonia has engaged in willful violations of the applicable provisions of the
Americans with Disabilities Act, 42 U.S.C. § 12101 et seq., and its implementing regulations, by flagrantly disregarding explicit, structural requirements for ATMs to be fully accessible to, and independently usable by, individuals with disabilities.
