Earlier this month, attorneys from Kalikhman & Rayz, LLC initiated a class action against Ability Recovery Services, LLC – a Pennsylvania-based debt collector. As detailed in the complaint, which was filed in the U.S. District Court for the Eastern District of Pennsylvania, Ability Recovery Services, LLC routinely sent correspondence to consumers containing false promises of “time sensitive” offers to settle outstanding debts. Moreover, the company failed to make accurate reports to the credit reporting agencies when the debts were disputed. These practices are unlawful under the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq., as well as the Unfair Trade Practices and Consumer Protection Law, 73 Pa.C.S. § 201.1 et seq., and their egregious nature is further amplified in relation to the clients of Kalikhman & Rayz, LLC, who did not owe the debt at issue in the first place.
