Recently, together with our colleagues at Connolly Wells & Gray, LLP, attorneys from Kalikhman & Rayz, LLC initiated a class action against Bank of America, N.A. and Nationstar Mortgage – a leading non-bank residential mortgage servicer, based in Texas. As detailed in the complaint that was filed in the U.S. District Court for the Eastern District of Pennsylvania, Bank of America and Nationstar failed to provide loan modifications to desperate borrowers even after promising to do so, which violated the Equal Credit Opportunity Act , 15 U.S.C. 1691 et seq., the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq., and common law.
