On July 20, 2012, the Pennsylvania Superior Court unanimously affirmed the opinion of the Hon. Gary S. Glazer of the Philadelphia County Court of Common Pleas in favor of a client of Kalikhman & Rayz, LLC, finding that our client’s “automobile dealer fraud” claims were not subject to private arbitration and should proceed to a jury trial in Philadelphia County. The opinion was prompted by an appeal by all of the defendants – a chain of local car dealerships, their financing company, and a global automobile manufacturer – who joined in seeking enforcement of an arbitration agreement.
